1. Acceptance of Terms

By accessing or using MixVibeConnect ("Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

MixVibeConnect is a platform that enables interactive music experiences at live events. DJs create events and manage music playback via connected streaming services, and guests suggest and vote on songs in real time.

3. User Accounts

  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 13 years old (16 in the EU/EEA) to use this Service.
  • One natural person may not maintain more than one account.
  • You must notify us immediately of any unauthorized use of your account.

4. User Conduct

You agree NOT to:

  • Use the Service for any illegal purpose
  • Harass, abuse, threaten, or harm other users
  • Post offensive, defamatory, or infringing content
  • Attempt to gain unauthorized access to the Service or other accounts
  • Interfere with or disrupt the Service infrastructure
  • Use bots, scripts, or automated systems to manipulate voting or song queues
  • Impersonate another person or entity
  • Circumvent rate limits, access controls, or security measures

5. User Content

You retain ownership of content you submit (chat messages, profile information, song suggestions). By submitting content, you grant MixVibeConnect a worldwide, non-exclusive, royalty-free license to use, display, and distribute it within the Service for the purpose of operating the platform.

You are solely responsible for the content you submit. We reserve the right to remove content that violates these Terms or applicable law.

6. Third-Party Music Services

MixVibeConnect integrates with Spotify, Apple Music, and other streaming services. Your use of these services through our platform is subject to their respective terms:

We are not responsible for the availability, accuracy, or content of third-party music services. A premium subscription to the connected streaming service may be required for full playback functionality.

7. Payments, Tips & Contributions

  • Tips and contributions to DJs are voluntary and non-refundable.
  • Payment processing is handled by Stripe. By making a payment, you agree to Stripe's Terms of Service.
  • MixVibeConnect charges a platform fee on DJ payouts. The fee rate is disclosed before each payout.
  • DJs receiving payouts must complete Stripe Connect onboarding and comply with all applicable tax obligations.

8. Copyright & DMCA Policy

We respect intellectual property rights. If you believe content on our platform infringes your copyright, you may submit a DMCA takedown notice to:

Your notice must include:

  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material that is claimed to be infringing and its location on the Service
  • Your contact information (name, address, email, phone number)
  • A statement that you have a good faith belief that the use is not authorized by the copyright owner
  • A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner
  • Your physical or electronic signature

Repeat infringers may have their accounts terminated.

9. Intellectual Property

The Service, including its design, logos, code, and documentation, is owned by MixVibeConnect and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without prior written consent.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIXVIBECONNECT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless MixVibeConnect, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Dispute Resolution

Any dispute arising from these Terms or your use of the Service shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction.

Class Action Waiver: You agree that disputes will be resolved on an individual basis and not as part of a class, consolidated, or representative action.

14. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions. For users in the EU/EEA, mandatory consumer protection laws of your country of residence apply.

15. Termination

We may suspend or terminate your account at any time for violation of these Terms, with or without notice. You may delete your account at any time through the Settings page. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive (liability, indemnification, dispute resolution) will survive termination.

16. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
